Federal law makes these provisions for vacancies:

The President - Vice President becomes President.

The Vice President
- the President nominates a Vice President who must be confirmed by majority vote of both houses of Congress.

The legal order of succession after Vice President is: Speaker of the House of Representatives, President Pro Tempore of the Senate, members of the Cabinet in a specified order (beginning with the Secretary of State).

New York law makes these provisions for vacancies:

U.S. Senate - The Governor appoints someone to the office until the vacancy can be filled at a general election.

U.S. House of Representatives - Depending upon date, vacancies are filled at a special election or at the next general election.
